If you bought or paid for 30 mg or 60 mg brand name or generic Adalat CC® from October 1, 1999 to the present, you could get a payment from this class action settlement.
Plaintiffs and indirect purchasers of 30 mg or 60 mg generic or branded Adalat CC® (“Adalat”) have reached a settlement of this case with Biovail Corporation, Biovail Technologies Ltd., Biovail Pharmaceuticals, Inc., Elan Corporation plc, Elan Pharmaceuticals, Inc., Teva Pharmaceutical Industries, and Teva Pharmaceuticals USA, Inc. (the “Defendants”).
The settlement will provide $8,200,000 for the benefit of companies and individuals that purchased generic or branded Adalat from October 1, 1999 to the date on which the Court finally approves the settlement. To benefit from the settlement you must have paid amounts independent of or in addition to health insurance co-pay amounts for purchases by yourself or others of generic or branded Adalat other than purchases made directly from one of these companies: Biovail Corporation, Biovail Technologies Ltd., Biovail Pharmaceuticals, Inc., Elan Corporation plc, Elan Pharmaceuticals, Inc., Teva Pharmaceutical Industries Ltd., or Teva Pharmaceuticals USA, Inc. (“Defendants”).
The settlement resolves a lawsuit over whether Defendants agreed to allocate the Adalat market; it avoids costs and risks to you from continuing the lawsuit against the Defendants; it pays money to buyers like you; and it releases the Defendants from liability. Class Counsel will also ask the Court to authorize payment from the settlement amount to a third-party Claims Administrator of the costs of publishing and mailing notice to Class Members and the costs of administering the settlement. The Plaintiffs and Defendants disagree on how much, if any, money could have been won by the Plaintiffs if they had proceeded to go to trial against the Defendants.
